ACCESS TO MONTANA STATE CRIMINAL RECORDS

To find out if an individual has a criminal record in the state of Montana we check the state repository, the relevant county criminal court records, and civil court records. 

All fifty-six (56) counties of Montana and the state repository report that felony records are available by phone, mail, or fax.  If the county can only mail records back to us then there will be an unavoidable delay. 
                 
Only three counties require a signed release from the subject of the search. District courts handle felony records and civil case filings involving amounts of over $5,000. Misdemeanor records and civil case filings involving amounts of less than $5,000 are handled in Justice Courts.

• Felonies are crimes that are usually punishable by at least one year or more of jail time.
• Misdemeanors are less severe charges punishable by a fine or jail time of less than one year.
