ACCESS TO GEORGIA STATE CRIMINAL RECORDS

To find out if an individual has a criminal record in the state of Georgia we check the state repository, the relevant county criminal court records, and civil court records.

         
Availability by County
Of Georgia's one hundred and fifty nine (159) counties, one hundred and two (102) require that request for criminal record searches be made in person. However, a release is not required for any of these counties.  The fifty-seven (57) remaining counties allow request by phone, mail or fax. If the county, or counties, specified can only mail records back to us then there will be an unavoidable delay in processing the record request.
                
The Superior Courts handle felony case records and civil case filings involving amounts over $5,000. State Courts handle all civil case filings involving amounts of less than $5,000. Misdemeanor case records are usually handled by the Superior Court. Exceptions are noted. In most counties, the superior and State Courts are house within the same building.

Georgia State Repository limits access to Felony and Misdemeanor convictions ONLY.
Signed release IS required for a statewide search.
State records contain information submitted to the State of Template from each county and other criminal justice agencies. Records are updated monthly.
Records are available for convictions dating from 1987 to today.  Prior to 1987, searches can be conducted by Federal or County records.

This information is based upon name, date of birth, sex, race, and Social Security Number.

Cost is $18 per individual searched statewide and $20 for a county criminal.
Delivery Time: Turnaround time is approximately 3-5 business days. Results are e-mailed to you, or faxed on request. We cannot guarantee turnaround time as we are dependent on the state getting back to us in a timely fashion.  If the county, or counties, specified can only mail records back to us then there will be an unavoidable delay in processing the record request.

Note: Georgia has a unified court system (see below), that applies to the superior courts, state courts (in larger counties), probate courts, juvenile courts, and other county-level courts.

What you should know before you order a State Criminal Search in order to gauge the severity of a criminal record, if one is found:
  • Felonies are crimes that are usually punishable by at least one year or more of jail time.
  • Misdemeanors are less severe charges punishable by a fine or jail time of less than one year.

In accordance with the directive of Article VI, Section IX, Paragraph I, of the Constitution of the State of Georgia of 1983, the Uniform Rules for Superior Courts and the Uniform Rules for State Courts are hereby adopted by order of the Supreme Court of Georgia.

These rules shall be effective July 1, 1985, and shall apply to all pending cases, except that Rule 5 shall not be applied in any case prior to January 1, 1986.
