ACCESS
TO DELAWARE STATE CRIMINAL RECORDS
To
find out if an
individual has a criminal record in the
state
of Delaware we check the state repository, the relevant
county criminal court records, and civil
court records.

All
three (3) counties in Delaware make criminal and
civil records available in person only.
However, the state repository will allow criminal
record searches by mail if a full set of
fingerprints is supplied. Fingerprints must
be clear and may be obtained at local police
departments. Superior Courts hold felony and
misdemeanor records and civil case filings
involving amounts of over $10,000. The
Courts of Common Pleas also hold misdemeanor
records as well as civil case filings of less than
$10,000. Both courts are housed within the
same building

| The
Delaware State Repository limits access to
Arrest Records, Felony
and Misdemeanor convictions ONLY. |
|
| Signed
release IS required along with Fingerprints for a
statewide search. It is NOT required for county
criminal records. |
|
| State
records contain information submitted to the State
of Delaware from each county and other criminal
justice agencies. Records are updated daily. |
|
| Records
are available for convictions dating from 1987 to
today. Prior to 1987, searches can be
conducted by Federal or County records. |
|
| Cost is
$42 for a statewide search and $20 for a county
criminal. |
|
| Delivery
Time: Turnaround time is approximately 16 business
days. County criminal records come back within 3-5
business days. Results are e-mailed to you, or faxed on
request. We cannot guarantee turnaround time as we
are dependent on the state getting back to us in a
timely fashion. If the county, or counties,
specified can only mail records back to us then
there will be an unavoidable delay in processing
the record request. |

| What
you should know before you order a State
Criminal Search in order to gauge the severity
of a criminal record, if one is found: |

- Felonies
are crimes that are usually punishable by at least one
year or more of jail time.
- Misdemeanors
are less severe charges punishable by a fine or jail
time of less than one year.
