TO ALABAMA STATE CRIMINAL RECORDS
To
find out if an
individual has a criminal record in the
state
of Alabama we check the state repository, the relevant
county criminal court records, or civil
court records.

Availability
by County
Of the sixty-seven (67)
counties in Alabama, forty-six (46) reported that they
make criminal record information available by mail,
phone or fax without a signed release. If
the county, or counties, specified can only mail records
back to us then there will be an unavoidable delay in
processing the record request.
Fourteen (14)
counties require searches be done in person, with no
release required. Only four (4) counties require a
signed release.
State
Repository
The state's central repository, the
Alabama Department of Public Safety, may be used for a
statewide criminal record search if the request is
mailed and includes a signed, notarized release. Alabama
also offers a source for statewide criminal, civil and
traffic records through the Administrative Office of the
Courts (AOC). The AOC is the computerized record keeping
system for Alabama and allows access via computer and
modem only. Civil records are available through each
county or the AOC. Felony records and civil cases of
$5,000 or more are filed in Circuit and District Courts
usually reside within the same building.
Criminal, Civil and Arrest
Records
Criminal
cases are actions brought by the state or
federal government against an individual charged
with committing a crime. There are basically
three types of criminal acts, or offenses, in
Alabama:
- Felonies
are offenses for which a sentence to a
term of imprisonment for more than one year may
be imposed and includes such offenses as murder,
robbery, and arson.
- Misdemeanors
are less
serious offenses for which a sentence to a term
of imprisonment not exceeding one year may be
imposed and includes such offenses as disorderly
conduct, criminal trespass, and most traffic
offenses.
- Violations
are given for offenses for which a
sentence to a term of imprisonment not in excess
of 30 days may be imposed and includes such
offenses as loitering and public intoxication.
- Exceptions:
a
municipal ordinance violation is an offense
against a municipality for which a sentence to a
term of imprisonment of not more than six months
may be imposed, with the exception that, in
Driving Under the Influence (DUI) cases, a
sentence to a term of imprisonment not in excess
of one year may be imposed.
Civil
cases are actions in which an individual,
business, or agency of government seeks damages
or relief from another individual, business, or
agency of government. Typical examples are suits
for damages arising from an automobile accident,
breach of contract or warranty actions, medical
malpractice cases and divorce proceedings
(referred to as domestic relations cases).

records contain information submitted to the State
of Alabama from each county and other criminal
justice agencies. Records are updated monthly. |

| Records
are available from 1993 to
today. Prior to 1993, searches can be
conducted by Federal or County records. |

| Cost is $20 per individual
searched. |

| Delivery
Time: Turnaround time is approximately 1-3 business
days. Results are e-mailed to you, or faxed on
request. We cannot guarantee turnaround time as we
are dependent on the state getting back to us in a
timely fashion. |

should know before you order a State Criminal Search in
order to gauge the severity of a criminal record,
if one is found: |

- Felonies
are crimes that are usually punishable by at least one
year or more of jail time.
- Misdemeanors
are less severe charges punishable by a fine or jail
time of less than one year.
